Terms and Conditions
By selecting the checkbox to indicate your acceptance of these terms and conditions, you are acknowledging that they have been entered into and are now in effect.
Terms not specified in this Agreement shall be in accordance with legally binding Tenancy Agreements such as Assured Shorthold Tenancy, Company Let Tenancy and Common Law Tenancy which include the Housing Act, Common Law & Law of Property Act. In addition, terms not specified shall be in accordance with the Agents Terms & Conditions which can be found on the Smarter Rent website, should you wish to read through them.
1. The Tenant agrees to abide by all rules and regulations set forth by local & UK laws.
2. The Tenant agrees to behave respectfully and be good neighbours' respecting the surrounding property owners' rights. Creating a disturbance of the above nature shall be grounds for immediate termination of this Agreement and therefore the booking.
3. The Tenant commits not to use the property for any illegal or commercial purpose, including but not limited to sub-leasing the property or otherwise allowing anyone or more people to stay above the maximum permitted or if not previously agreed with the Owners Agent.
4. Smarter Rent will carry out inventory & house videos pre check in and post check out to ensure our homes are always kept up to standard. The Tenant is responsible for any breakage & damage related costs at the property which are caused by the Tenant or any members of the Tenant's party, as well as any extra costs for labour as a result. This includes but is not limited to: internal property damage (that does not fall under fair wear and tear), any damages to furniture, ruining of bed linen or towels due to pet hair, make up or fake tan stains caused by the Tenant, Tenants party or Tenants Pets will be charged back to the Tenant via the booking card. Tenants will also be charged if any pet faeces are left at the property in the garden or otherwise.
5. The Owner/Owners Agent can refuse to allow the Tenant into the property or ask the Tenant to leave if they reasonably believe the Tenant or any member of the Tenant's party (or any other person invited by the Tenant to the property) are behaving illegally. Also, that any damage is likely to be caused, has been caused or is being caused as a result of the Tenant behaviour or any members the Tenant has invited to the property. Without providing a refund of any payment, the Tenant has paid for the booking, and the Owner/Agent will not be legally responsible for finding any alternative accommodation.
6. If parking is stated as available within specified accommodation, parking is limited to designated parking areas or limited spaces available with that property only. The Owner/Owners Agent holds no liability for theft or damage to the Tenants vehicle and it is parked at the Tenants own risk.
7. Most of our homes are Dog friendly but any pets are only allowed with prior consent from the Agent. We do please ask that dogs do not go in/on the beds & that you clean up after them. If we have not been made aware you have a pet/pets in the property then we do reserve the right to charge the booking card for additional cleaning fees on check out.
8. The Tenant must not hold events (such as parties, or meetings) at the property without the Agents advance written consent. Any of these cases will allow the Agent to terminate the Agreement without providing a refund of any payment the Tenant has paid for the booking. The Owners Agent will not be legally responsible for finding any alternative accommodation.
9. The Tenant must allow the Agent (including the Agents contracted workers), with reasonable notice, access to the property at any reasonable time during your stay (except in an emergency or if a problem needs sorting out quickly and we cannot contact you in time. In these situations, the Agent can enter the property at any time without giving you prior notice).
10. The Tenant is obliged not to make any changes in the property without consent from the Agent in writing.
11. By agreeing to this agreement, as acknowledged by signature below, the Tenant waives, discharges and agrees to hold harmless Owner/Agent from all damages or injuries arising from or related to the Tenant stay at the property, including without limitation, any accidents, injury or death to the Tenant, Tenant's visitors and associates, theft and loss of money, jewellery or valuables of any kind. We recommend that Tenants have their own insurance.
12. We regret we cannot accept liability or pay any compensation where our contractual obligations' performance or prompt performance is prevented or affected by forces outside of our control. In these Terms and Conditions, forces outside of our control means any event which we (The Agent) could not, even with due care, foresee or avoid. Such events may include but are not limited to acts of God, unforeseen home system breakdowns, gas/electric/water supplier outages, or other events outside our control.
13. The person booking this property warrants they are older than 18 years and has the authority to use the credit card or bank details provided to make payment.
14. This Agreement is ultimately between the Owner/Agent and the Tenant. Any disputes arising from the rental of the property will be resolved between the Tenant and the Owner/Owners Agent and if applicable the booking platform will be involved. The Jurisdiction of this rental Agreement is the United Kingdom.
15. The Tenant must agree to the no smoking policy inside all of our properties, if the Owner/Agent suspects that this policy has been broken, the Agent will charge additional cleaning fees to the card details submitted for the booking.
16. We try to do our bit to look after our planet so please help us to do so. The Tenant agrees to ensure all rubbish has been correctly separated, as per the arrival email information, and rubbish bins have been placed in the allocated place outside of the property to allow them to be collected by the council. If the rubbish bins have not been put out for collection, we reserve the right to charge the booking card for additional rubbish removal.
17. We ask that the tenant please check out of our homes on time to allow us time to prepare for the next guest. The Tenant must agree to our Check in & Check out times & policy, if Tenants are late checking out of the property (without prior consent from us) we reserve the right to charge a late check out fee which is equal to the cost of 1 night.
T&C Changes:
Any change or addition to these Terms & Conditions will be valid only if confirmed in writing and both the Agent & Guest have signed.
